1. Acceptance of These Terms
These Terms of Service ("Terms") form a legal agreement between you and Felinius ("we," "our," or "us") and govern your access to and use of the Felinius mobile application and related services (the "App").
By tapping "Agree," creating an account, or otherwise using the App, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the App.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian.
By using the App you represent that you meet these requirements and that the information you provide is accurate.
3. Your Account
The App requires you to sign in with a Google or Apple account. You are responsible for maintaining the security of the account you use to sign in and for all activity that occurs under it.
You agree to provide accurate information and to keep it up to date. Please notify us promptly at myfelinius@gmail.com if you believe your account has been compromised.
4. Licence to Use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own personal, non-commercial use.
You may not: copy, modify, or create derivative works of the App; reverse-engineer, decompile, or attempt to extract source code except to the extent permitted by law; rent, sell, sublicense, or distribute the App; or remove any proprietary notices.
5. Your Content & Data
The App lets you create and store content such as cat profiles, vet visits, bills and receipt images, check-ins, and community posts ("Your Content"). You retain ownership of Your Content.
You grant us a limited licence to host, store, process, and display Your Content solely to operate and provide the App to you (for example, to sync your records across your devices and to show community posts you choose to share). How we handle Your Content is described in our Privacy Policy.
You are responsible for Your Content and confirm you have the rights necessary to submit it. A guiding principle of Felinius is that most processing happens on your device, and your private records — bills and receipt images, health and vet records, weights, food, medications, and check-ins — are never shared with other users. Your cats' names, breeds and profile photos become visible to other users only after you join the community and only for the cats you choose to make discoverable, and any photo and caption you post to the Town square or a photo event is public to other users of the App.
6. Acceptable Use
You agree not to use the App to:
- break any applicable law or regulation;
- infringe the rights of others, including intellectual property and privacy rights;
- upload content that is unlawful, harmful, harassing, hateful, or that you have no right to share;
- attempt to gain unauthorised access to the App, other users' data, or our systems;
- interfere with, disrupt, or place undue load on the App or its infrastructure; or
- use automated means to access the App in a way that harms the service.
7. Community Features & Conduct
The App includes optional community features where you may share low-sensitivity events (such as joining or activity milestones), choose from a fixed set of friendly messages, and discover other users' cats. Those posts are generated from a fixed set of server-side templates; the App does not transmit free-form prose you write about your cats, bills, or health to the public feed.
Separately, you may publish a photo together with a short caption you write yourself in the Town square and in photo events. This is the only content in the App where your own words are published. By posting, you confirm the photo is yours to share and that it and your caption comply with Section 6. Captions and images are screened automatically before they appear — images are checked by an automated safety service, described in our Privacy Policy — and posts are subject to daily limits. Posts may be hidden automatically after multiple reports, we may remove them, and you can delete your own posts at any time.
You may also send private direct messages to neighbours you already know in the Town square. Messages are seen only by you and the person you are talking to, but they are still Your Content and must comply with Section 6: no harassment, threats, hate, spam, or sexual or otherwise unwanted content. Messages are screened automatically before they are sent and are subject to sending limits. From any conversation you can report a message or block the other person. We review reported messages and may remove content, restrict messaging, or suspend or close accounts that break these Terms. We have zero tolerance for objectionable content and abusive users.
When you collect another user's cat or interact in the community, you agree to do so respectfully. We may remove content or limit access to community features that we reasonably believe violate these Terms.
8. Companion, XP & Virtual Items
The App includes an in-app companion, experience points (XP), quests, and other gamified or virtual elements. These have no monetary value, cannot be exchanged for money or anything of value, and are provided for your enjoyment only. We may modify, manage, or discontinue these elements at any time.
9. No Veterinary or Professional Advice
Felinius is an organisational and companion tool, not a veterinary service. Any information, records, reminders, summaries, or AI-generated text in the App are for general informational and record-keeping purposes only and are not veterinary, medical, or professional advice.
Always seek the advice of a qualified veterinarian for any questions about your animal's health. Never disregard or delay professional advice because of something you read or recorded in the App. You are solely responsible for decisions about your pets' care.
10. Third-Party Services
The App relies on third-party services, including Google Sign-In, Sign in with Apple, Google Cloud, and Firebase, and may link to third-party websites or documents. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the content or practices of third parties.
11. Intellectual Property
The App, including its software, design, text, graphics, companion characters, and other materials (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. Except for the licence granted to you in these Terms, no rights are transferred to you.
12. Disclaimers
The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, or that data will never be lost. You are responsible for keeping your own backups of important information where possible.
13. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the App.
To the maximum extent permitted by law, our total liability for all claims relating to the App will not exceed the greater of the amount you paid us to use the App in the twelve months before the claim, or fifty Malaysian Ringgit (RM50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold us harmless from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your misuse of the App, your violation of these Terms, or your violation of any law or the rights of a third party.
15. Suspension & Termination
You may stop using the App at any time and may request deletion of your account and data as described on our Account & Data Deletion page.
We may suspend or terminate your access to the App if you breach these Terms or if we reasonably need to do so to protect the service or other users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
16. Changes to the App & These Terms
We may update the App and these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and, where appropriate, ask you to review and accept the updated Terms within the App before continuing to use it.
Your continued use of the App after changes take effect means you accept the updated Terms.
17. Governing Law & Jurisdiction
Primary Jurisdiction: Malaysia
These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict-of-law principles.
Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Malaysia, and you consent to personal jurisdiction and venue therein. Where local laws grant you rights that cannot be waived, nothing in these Terms limits those rights.
